Lawyer Lee Suet Fern, who has found herself a target in an acrimonious dispute over the handling of the colonial home of modern Singapore’s late founder Lee Kuan Yew, has issued a detailed defense through her counsel of her role in the execution of the elder Lee’s will. 

Singapore Prime Minister Lee Hsien Loong has been feuding for months over the disposal of the home, at 38 Oxley Road, with his brother Lee Hsien Yang and sister Lee Wei Ling, who say the late premier wanted the home torn down to keep it from being turned into a shrine for the late statesman’s memory. Lee Suet Fern is married to Lee Hsien Yang, a prominent Singapore businessman.

The matter landed before a disciplinary tribunal of the Singapore Law Society that found Lee Suet Fern had misled Lee, who died in 2015 at 91, into changing his will, which included a clause on demolishing the house. Lee Suet Fern’s counsel argued she played only a minor role in the writing of the will and that the final will was largely a reversion to the first will in 2011.

The Lees, Singapore’s first family, have been locked in the squabble since 2016 over the house, which has shocked the Singaporean public with its virulence and threatens to shake the foundations of the People’s Action Party, which has governed the city since 1959 and independent Singapore since 1965. 

In a public statement on June 14, 2017, Lee Hsien Yang and Lee Wei Ling said, “We feel big brother omnipresent. We fear the use of the organs of state against us and Hsien Yang’s wife, Suet Fern. The situation is such that Hsien Yang feels compelled to leave Singapore.”

Thousands of pages of documents have been filed in the closed-door disciplinary tribunal over the issue. On February 23, the Singapore Straits Times, which is normally pro-government, ran three full pages of articles which were fairly damning of Lee Suet Fern and her husband over her role in the patriarch’s will.

To the tribunal’s accusation that she had allegedly tricked the ailing former prime minister into changing his mind over his will, Suet Fern’s lawyers answered that Lee was “of sound mind and in full command of his faculties when he executed the December 2013 will. He was a man of sharp intellect who knew exactly what he wanted.”

“It is clear that Mr. Lee Kuan Yew knew exactly what he wanted:” which was to revert substantially to the first version of his will in August 2011, in which he bequeathed equal shares of his estate to all his three children, said Suet Fern’s lawyers, Kenneth Tan, a Singapore senior counsel, and Walter Woon, a former Singapore attorney general and senior counsel.

Suet Fern is disputing the Singapore Law Society’s finding that she was guilty of grossly improper professional conduct over the will. The Law Society’s disciplinary tribunal report, dated February 18, accused her of being a “deceitful witness who tailored her evidence to portray herself as an innocent victim who had been maligned.” The report also accused Lee Hsien Yang of being “equally deceitful.” 

“The alternative which the Law Society is putting forward is that Mr. Lee Kuan Yew, a very brilliant lawyer and world statesman, did not understand his own will despite reading it several times,” according to Suet Fern’s counsel.

The disciplinary tribunal report alleged that on December 16, 2013, Lee Suet Fern and Lee Hsien Yang “persuaded” Lee Kuan Yew “(then a 90-year old man in poor health, who had recently been hospitalized for several weeks, with serious medical conditions) to sign a new will without his usual lawyer to advise him. They cut off that lawyer from communications with Mr. Lee on the last will, and rushed through the execution of the last will, in her absence.”

Lee Kuan Yew’s lawyer was Kwa Kim Li, a niece of his late wife Kwa Geok Choo. Kwa is managing partner of Lee and Lee, a law firm founded by Lee Kuan Yew and his wife.

The disciplinary tribunal, which consisted of two lawyers, deemed Lee Suet Fern’s actions sufficiently serious that the case will be decided by the Court of Three Judges, Singapore’s highest disciplinary body to deal with lawyers’ misconduct. The court is provisionally scheduled to hear the case in August. If found guilty, Suet Fern could face a fine, suspension or disbarment.  

At no time during the remaining 15 months of his life did Lee Kuan Yew indicate that the will which Lee Suet Fern helped draft in December 2013 did not represent his intentions, nor did Kwa raise any objection to that will, argued the defense counsel.

On December 16, 2013, according to their defense, while Kwa was abroad, Lee Kuan Yew emailed Lee Hsien Yang saying, “OK. Do not wait for Kim Li. Engross and I will sign it before a solicitor in Fern’s office or from any other office.”

Lee Wei Ling, a doctor, wrote on her Facebook on February 28, “LKY told me himself that he wanted to revert to his 2011 will and was merely wanting a witness. He wanted very prompt follow up and was indifferent where the lawyer came from.”

On December 17, 2013, Lee Kuan Yew executed his last will, having read and initialed every page.

On the same day, Elizabeth Kong, a lawyer of Stamford Law Corporation (founded by Lee Suet Fern), told Suet Fern that she could see Lee Kuan Yew was “getting very frail. He was slurring in his speech so it was difficult to understand what he was saying. But he is definitely still very lucid…. [Lee Kuan Yew] read through every single line and was comfortable to sign,” said the disciplinary tribunal report.

Also on December 17, 2013, Lee Suet Fern informed Kwa by email that Lee Kuan Yew had executed his final will. A copy of the executed will was sent to Kwa on Lee Kuan Yew’s instructions on the same day.

If Lee Suet Fern and her husband meant to cut Kwa out of the preparation of the last will, there was no reason to send her a copy of the will before execution nor tell her after the event that it had been done, Lee Suet Fern’s counsel argued. Kwa did not reply to questions emailed to her.

On 2 January 2, 2014, Lee Kuan Yew personally drafted a codicil to his will. 

“After signing his final will in 2013, Lee Kuan Yew independently drafted and executed an amendment to the will (a codicil) which referenced the final will. Of course, he knew exactly what he was doing,” said Lee Wei Ling on her Facebook on March 2.

The disciplinary tribunal report stated, “It is not in dispute that some differences between the penultimate will (which Lee Suet Fern was involved in) and the last will were not brought to Mr. Lee’s attention.”

Lee Suet Fern did not alert Kuan Yew to all the differences between what the patriarch had earlier wanted and what the final will provided for, the report alleged. Her lawyers played down the differences as minor.

The differences include the absence of a gift-over clause in the final will, where the share of inheritance would pass from an heir to his offspring should the heir die. An addition in the final will is a clause giving Lee Wei Ling the right to live in her father’s house as long as she wishes and instructions for the demolition of that house after she moves out. 

The Law Society disciplinary tribunal found Lee Suet Fern was Lee Kuan Yew’s lawyer while his final will was prepared on December 16, 2013 and executed on December 17, 2013. Its report alleged she “managed every aspect of the process” over these two days. Lee Suet Fern’s counsel argued their client was not Lee Kuan Yew’s lawyer and her role in the will was minor. 

The Law Society did not reply to questions emailed to it. Tan Chee Meng, a lawyer acting for the Law Society, declined to comment.

Since 2017, Lee Wei Ling and Lee Hsien Yang have been conducting a campaign on Facebook alleging impropriety by their brother. Prime Minister Lee has denied all wrongdoing. Toh Han Shih is a Singaporean writer in Hong Kong.

Thailand’s controversial king Maha Vajiralongkorn, despite being protected by some of the most stringent lèse-majesté laws in the world, has come under unprecedented attack by young Thais who have taken to Twitter and Facebook to denounce him for his apparent disregard of his subjects during the Covid-19 crisis. 

“He has been heavily criticized for not caring about his subjects at home, for continuing to enjoy an indulgent life with a harem in a German hotel,” said a source who is living in exile overseas. “Criticisms from international media are not strange. What is phenomenal is the fact that Thais, especially the younger generation, are now willing to talk about this openly, especially on Twitter. They asked a pertinent question: ‘Why do we need a king?’ This shows a shift in the people’s attitude toward the monarchy. Many years ago, this would have been unimaginable. Today, cursing at the king seems normal.”

The appearance of criticism on social media of the 67-year old king, who accepted the throne on December 1, 2016 as the latest monarch in the 238-year-old Chakri dynasty, is extraordinary and seems to flow to places where Thai censors aren’t nimble enough to follow, including using arcane and derogatory references to the king on a K-pop news outlet normally used for dating rumors. Younger Thais are getting bolder, a source said, especially given the king’s apparent lack of concern for the plight of the economy, which is collapsing under the weight of the virus and other problems.

“These are new revelations to millions of Thais,” an expatriate source told Asia Sentinel. Apparently, not just the young but people across the country have been given access to a barrage of YouTube videos providing details, not only Vajiralongkorn’s life and antics, but of the whole royal family. The effect has been to debunk the myths of divinity and sacredness of the family, shocking middle-aged Thais to the extent that respect for the monarchy is becoming a casualty.

The hashtag #มีกษัตริย์ไว้ทำไม or #WhyDoWeNeedKing was the top Twitter feed in Thailand earlier this week, an indication of the erosion of the monarchy’s position in politics despite the military’s attempts to prop it up and a sign that despite harsh laws on criticism, more and more people are in favor of bringing the monarchy under scrutiny.

Almost certainly some of the anger spilling out on the part of Thailand’s young is due to the decision by authorities to outlaw the Future Forward party, which gathered six million votes in last year’s election and whose charismatic leader, the 41-year-old Thanathorn Juangroongruangkit, a political aristocrat connected to the country’s biggest auto parts manufacturer and several establishment figures, has been threatened with imprisonment for no other reason than the popularity of his youth movement .

“I guess it is hard to control the viral posts on Twitter,” said Puangthong Pawakapan, a lecturer in international relations at Chulalongkorn University in Bangkok. “The more the state tries to suppress it, the more it has gone viral. Also, the way they wrote the posts on Twitter, it is difficult for the authorities to pinpoint that they were discussing the monarchy. For example, they shared a poster of the Korean film ‘The Kingdom’ and said the hashtag is about the film. Of course, readers know the true meaning of it. I got the sense among the young tweeters that they thought they could get away with it.”

The military government tightly controls all media through the lèse-majesté laws as well as the Computer Crime Act passed in 2016, which provides sweeping powers to restrict free speech, enforce surveillance of websites and provides for extraordinary censorship. Veneration of the king ordered by the military has achieved comic levels, with photos of commoners even crawling beneath the king’s portraits. People have dared punishment for even not showing enough respect to distant royal relatives. Prayuth and top army officials routinely crawl on the floor in his presence.

Despite the stranglehold on the media, which extends to newspapers and television, the public has become enraged over the king’s decision not only to stay in Germany, where he lives most of the year, but to rent the entire four-star Grand Hotel Sonnenbichl in the famed Alpine resort town of Garmisch-Partenkirchen with an entourage that is said to include a harem of 20 concubines and numerous servants, according to the German tabloid Bild.

In the meantime, as he wallows in luxury, the king’s 70 million-odd subjects have been subjected to an unprecedented lockdown as the coronavirus has spread, badly denting an already-ailing economy. After dithering for weeks over the damage to the country’s tourism industry, which represents up to 20 percent of GDP, Prime Minister Prayuth Chan-ocha finally announced on March 26 that the nation’s borders would be closed to foreign visitors, social gatherings have been banned, domestic travel restricted and all but essential shops have been shut until the end of April. Although officially only 1,524 were recorded with the virus at the time of publication, testing has been sporadic at best and health officials say every recorded victim could represent as many as 2,000 who are in fact ill.

With the king spending most of his time in Germany, returning only for ceremonial events in marked contrast to his father, the late Bhumibol Adulyadej, who famously never left the country, irritation and frustration have continued to climb. A pilot who trained in the Royal Thai Air Force, the king flies his own Boeing 737 with its own livery although he has been known to borrow jets from the ailing Thai International, which because of the coronavirus may be facing extinction. Last October, the airline had already warned it could face bankruptcy.

Since taking the throne, Vajiralongkorn, who was regarded as unacceptably volatile during his years as crown prince, has acted in unsettling ways to attempt to return the throne to the absolute monarchy that the military ended in 1932, including forcing changes to the constitution to allow him to exercise his authority even when he is away from the country in Germany. He has won control of the Crown Property Bureau, whose assets are valued at an estimated US$60 billion and has enlarged his own private army to the point where it has unsettled the regular military. He now controls some of the most expensive land in Bangkok and is able to use it at his own whim.

But it is his own personal behavior that has unsettled elite society to an almost unacceptable extent. The world got a preview of that well before he ascended to the throne. He has married four times and fathered seven children. When he decided to get rid of his then-wife Princess Srirasmi, a former cocktail hostess, in 2014, he humiliated her, forced her into exile outside Bangkok and arrested many of her family. On his ascent to the throne, several top aides disappeared, with some having died in questionable circumstances.

Last year, months after he married his fourth wife, Suditha, he took a “royal consort,” Sineenat Wongvajirapakdi, and shortly afterwards stripped her of her rank for having been “ambitious” and trying to “elevate herself to the same state as the queen.”

Cables from the US Embassy in Bangkok released by Wikileaks several years ago indicated that many in the power structure didn’t view the then-crown prince as a suitable successor. One cable described his dog Foo Foo a marshal in the Royal Thai Air Force and allowing the dog to graze on food atop tables at an official banquet.

A leaked video of a birthday for Foo Foo, complete with a naked Princess Srirasmi, his now-discarded wife, is now circulating widely along with videos of Buddhist funeral rites when Foo Foo died in 2015. Previously these videos circulated among the elite in Bangkok. Now they have spread to the general populace, causing shock.

The military and the palace have had what is described as a symbiotic relationship since the 1960’s that was based on mutual benefit, with the military gaining the patronage and pride of being the protector of the monarch and the impunity that goes along it, while the palace was assured of a bedrock of supporters with arms prepared to act if needed.

The living example of that was Prem Tinsulanonda, the onetime army chief who subsequently served as prime minister and went on to head the royalty’s privy council, remaining deeply influential, especially with Bhumibol, almost until his death at age 88 in May 2019.

Today, there is widespread concern at the top of Thai society that they have created a monster in the form of Vajiralongkorn and his increasingly ostentatious relatives who cannot be controlled. But, embarrassed as the Thai elites may feel about the spectacle of an erratic king, attempting to force his abdication is fraught with dangers. MUHYIDDIN – THE TYPICAL MALAY MINDSET?

When I heard the news that the Sunway Corporation pledged Rm34 million to the Covid Fund I shared the happy news with a few friends. At the same time I wondered aloud what happened to Mukhriz, Bukhary, Daim, Najib and all the rich Malays. What have these billionaire Malays contributed? 

A Malay friend took umbrage at the inconvenient question.“Why must it always be about race?” she shot back.

I explained to her that it is the system which has conditioned us to think and act racially. She should as the Malay leaders the very same question.

Indeed why must it be about race at all? I told her that I wished we could all be just Malaysians. If Americans are just Americans and Indonesians are just Indonesians (and they are a bigger melting pot than us) why are we Bumiputra Malaysians and Non-Bumiputra Malaysians? This is not just a label but it has real consequences for both the Malays and the non-Malays and for national unity.

Isn’t it sad when we read the news and it can be about anything; and our minds go Malay, Chinese or Indian?

Unfortunately this is how we have been conditioned by decades of racial policies.

When our prime minister proclaims himself to be “Malay first” and then only Malaysian what kind of example is he setting?

But let’s leave the politicians alone for today.

What about your average Malay on the street?

When my friend who is well educated and exposed and who I had assumed has a broader worldview than the average Malay took umbrage at my question, I start to wonder.. .

Firstly about myself. Am I a racist? Why did I couch my question in a racial context?

Secondly is she a racist? Taking offence with what I will admit is a provocative question. Is she liberal only when it suits her – that we are all Malaysians.

When political commentators say that we must first win the hearts and minds of the rural Malays if we want to win this war on racism; I wonder. Are the rural Malays the only ones anchored in race and religion?

Are the urban Malays, the educated middle class, the professionals and the rich any different? Is talk of  Bangsa Malaysia only skin deep – only when it suits them.

Let’s get down to brass tacks. Do you think it has not occurred to the educated middle class Malays that they have the privileges of discounts on house purchases, scholarships for their children etc. How will these be affected if there is Bangsa Malaysia. Will they lose them?

This is the crux of the problem:  When you attach privileges to race, how are you going to build a nation?

There have been calls for policies based on needs and not race. Everyone knows this is a fairer system and it cuts across race. At the same time it will focus our resources on the B40 and lift them out of poverty.

But how will the Malay middle class respond to this? When tangible sacrifices are involved that is when we separate the poseurs from those who genuinely are for a Malaysian nation.

One only has to look at the attendees at the MAJU Roadshow.

How many Malays show their support for MAJU’s call for Bangsa Malaysia,  and an end to racial and religious bigotry.

There lies your answer.

The commitment to equal citizenship by many goes only as deep as their privileges. They are all for Bangsa Malaysia but only if they remain Primus Inter Pares, with their privileges intact.


Do we call the non-Malays, Malaysians only when it suits us and when it suits ourselves we say  they are “guests”?

It will go a long way to uniting our country if the prime minister takes the lead in declaring himself Malaysian first period.

We must unite as one people not only during a crisis like what we are facing but also after Covid 19. Must it take another virus to make us realise we are All Malaysians whatever our ethnicity. It may be too late then.
