Dulu Allahyarham Dato Onn setelah keluar parti pun masak dituduh dan difitnah. Apakah tindakan beliau semasa hayatnya keluar Umno sebagai tidak bermaruah?.

Beliau seawal menyedari Perlembagaan Persekutuan yang dikarang, didraf dan diluluskan dengan tekanan Penjajah British. Beliau keluar parti antara sebab utamanya ialah tidak menyetujui kaum pendatang diberi kerakyatan secara automatik [tanpa syarat - dan Islam serta Melayu Islam telah menghadapi kesannya sehingga ke hari ini] Ekonomi Malaysia siapa gemabalanya sekarang? Islam sekadar sebagai Agama Rasmi. Kuasa pengadilan Mahkamah Syariah pun boleh dicabar di Mahkamah Persekutuan. Begitu juga dengan hal MURTAD yang termaktub dan terikat dalam Perlembagaan Persekutuan. Berapa kes murtad dapat ditewaskan setakat ini? Dakwa cucunya H2O beliau bermaruah dan bertekad kekal dengan Umno.

Apakah bangsa Melayu dan Melayu Islam masih perlukan petualang Islam dan pengkhianat bangsa untuk berkuasa?. Allah cabut rasa tidak malu, kepada pemimpin yang rosak untuk terus menegakan benang basahnya. Itu janji Allah Subhanahu Wa Ta'alla kepada hamba Nya yang ingkar. Jangan sampai kita menjadi golongan yang merugi di Akhirat kelak. Astagfirullahalazim. Nauzubillahminzalik.

Satu tragedi Politik Melayu telah pernah berlaku, kerana tipu daya, material dan kuasa serta pengaruh yang tidak boleh dicabar [salah guna kuasa]. Apakah akan berlaku lagi? Individu Melayu yang berkuasa, individu Melayu yang diberi amanah, tanggung jawab dan kepercayaan oleh Islam Agamanya dan bangsanya, Melayu yang punya pengaruh kalau tidak mahu duit [dan lain-lain bentuk rasuah] akan mematikan akal satu golongan atau kaum yang memang mengamalkan suka memberi rasuah.

Flashback – after the 12th general election on March 8, 2008, the then opposition Pakatan Rakyat (now defunct) surprisingly won the state of Perak. Armed with 32 seats against Barisan Nasional’s 27 seats, Mohammad Nizar was sworn is as the Mentri Besar (Chief Minister) of Perak. But less than a year later in February 2009, the crisis exploded.

Imbas kembali - Selepas pilihan raya umum ke-12 pada 8 Mac 2008, pembangkang Pakatan Rakyat (kini terbubar) telah mengejutkan negeri Perak. Bersenjatakan dengan 32 kerusi melawan 27 kerusi Barisan Nasional, Mohammad Nizar bersumpah sebagai Menteri Besar Perak. Tetapi kurang dari satu tahun kemudian pada bulan Februari 2009, krisis meletup.

The crisis began when a Barisan Nasional assemblyman – Nasaruddin Hashim – expressed his desire to switch side to PKR (People’s Justice Party), a component party of Pakatan Rakyat. PKR supremo Anwar Ibrahim happily accepted him, without realizing he was a trojan horse sent by PM Najib Razak. Days later, the mole re-defected back to Barisan Nasional.

Krisis itu bermula apabila seorang ADUN Barisan Nasional - Nasaruddin Hashim - menyatakan hasratnya untuk berpihak kepada PKR (Parti Keadilan Rakyat), sebuah parti komponen Pakatan Rakyat. Ketua Umum PKR Anwar Ibrahim gembira menerima dia, tanpa menyedari dia adalah kuda trojan yang dihantar oleh PM Najib Razak. Beberapa hari kemudian, tahi lalat itu kembali ke Barisan Nasional. 

Nasaruddin brought along with him 3 other Pakatan Rakyat assemblymen – including Deputy Speaker Hee Yit Foong, senior state Executive Council member Jamaluddin Mohd Radzi and Osman Jailu. Among the “three frogs”, Hee Yit Foong was the most despised traitor after revelation that Najib paid her at least RM25 million cash to defect.

Nasaruddin membawa bersama 3 wakil rakyat Pakatan Rakyat - termasuk Timbalan Speaker Hee Yit Foong, Ahli Dewan Undangan Negeri Jamaluddin Mohd Radzi dan Osman Jailu. Di antara "katak tiga", Hee Yit Foong adalah pengkhianat yang paling dihina selepas penyataannya bahawa Najib membayarnya sekurang-kurangnya RM25 juta tunai untuk pengkhianatan itu.

Interestingly, the other 2 defectors – Jamaluddin and Osman (PKR assemblymen) – had been accused of corruption prior to their defections, fuelling speculation that both frogs didn’t get paid as much as Hee Yit Foong (DAP assemblywoman). Perak State Assembly Speaker V. Sivakumar announced he had received the resignation letters of Jamaluddin and Osman but both denied they have resigned.

Menariknya, 2 lagi pembelot - Jamaluddin dan Osman (ADUN PKR) - telah dituduh rasuah sebelum pembelotan mereka, memunculkan spekulasi bahawa kedua-dua katak tidak dibayar seperti Hee Yit Foong (ADUN DAP). Speaker Dewan Undangan Negeri Perak V. Sivakumar mengumumkan beliau menerima surat peletakan jawatan Jamaluddin dan Osman, tetapi kedua-duanya telah menafikan mereka telah meletak jawatan.

Although the Speaker had declared the seats held by Jamaluddin and Osman were vacant, the corrupt and pro-Barisan Nasional “Election Commission” decided to reject the Speaker’s requests for by-elections to be held. The then-PM Najib Razak, who happened to be the head of Perak Barisan Nasional, sought an audience with Sultan Azlan Shah of Perak.

Walaupun Speaker telah mengisytiharkan kerusi yang dipegang oleh Jamaluddin dan Osman kosong, "Suruhanjaya Pilihan Raya" yang korup dan pro-Barisan Nasional memutuskan untuk menolak permintaan Speaker bagi pilihan raya kecil yang perlu diadakan. Perdana menteri Najib Razak, yang menjadi ketua Barisan Nasional Perak, telah meminta perkenan Sultan Azlan Shah Perak.

Chief Minister Nizar also had an audience with the Sultan of Perak and requested dissolution of the state assembly to pave way for a snap election on 4 January 2009. The Sultan of Perak, however, refused Nizar’s request for the dissolution request and asked Nizar and his cabinet to resign instead, citing his discretion under Article XVIII (2) (b) of the Perak State Constitution.

Menteri Besar Nizar telah mengadap Sultan Perak untuk memohon pembubaran Dewan Undangan Negeri sebagai membuka jalan untuk pilihan raya pada 4 Januari 2009. Namun Sultan Perak telah menolak permintaan Nizar untuk membubarkan Dewan Undangan Negeri Perak dan sebaliknya meminta Nizar dan Anggota Exconya untuk meletakan jawatan, dengan menyebutkan kebijaksanaannya berdasarkan Perkara XVIII (2) (b) Perlembagaan Negeri Perak.

Nizar refused to resign and asked the sultan to reconsider and dissolve the assembly. DAP supremo Lim Kit Siang had argued that the sultan was obliged to act on the advice of the Menteri Besar and call fresh elections, citing Article 16(6) of the Perak State Constitution. The crisis got so bad that pro-government police force was used to cordon off the state secretariat building.

Nizar enggan meletak jawatan dan meminta Sultan untuk menimbang semula dan membubarkan kerajaan negeri itu. Penasihat DAP Lim Kit Siang berhujah bahawa Sultan wajib bertindak atas nasihat Menteri Besar dan memanggil pemilihan baru, memetik Perkara 16 (6) Perlembagaan Negeri Perak. Krisis itu sangat buruk sehingga pasukan polis pro-kerajaan digunakan untuk mengepung Bangunan Sekretariat Kerajaan Negeri Perak.

In what appeared to be the “biggest black eye” to the country’s democracy, Perak Speaker Sivakumar was forcefully held, dragged and removed from the chamber to allow Najib’s man, R Ganesan, to be installed as the new Speaker. The Pakatan Rakyat assemblypersons had to conduct their assembly meeting under a tree in the parking lot of the State Secretariat building.

Dalam apa yang kelihatan sebagai "mata hitam terbesar" kepada demokrasi negara, Speaker Perak, Sivakumar dipaksa, diseret dan dikeluarkan dari ruang untuk membolehkan lelaki pilihan Najib, R Ganesan, diangkat sebagai Speaker baru. Ahli Dewan Undangan Negeri (ADUN) Pakatan Rakyat telah mengadakan mesyuarat di bawah pokok di tempat letak kereta bangunan Sekretariat Negeri.

On February 6th, Barisan Nasional assemblyman Zambry was appointed as the 11th Mentri Besar of Perak, replacing Mohammad Nizar. A week later, Mr. Nizar initiated legal action, seeking a court declaration that he is still the rightful chief minister. When DAP top lawyer Karpal Singh filed a lawsuit to challenge the Perak Sultan’s decision, he was slapped with sedition charges instead.

Pada 6 Februari, Adun Barisan Nasional, Zambry telah dilantik sebagai Menteri Besar ke-11 Perak, menggantikan Mohammad Nizar. Seminggu kemudian, Encik Nizar memulakan tindakan undang-undang, memohon pengisytiharan mahkamah bahawa dia masih menjadi Menteri Besar yang sah. Apabila peguam kanan DAP, Karpal Singh memfailkan tuntutan undang-undang untuk mencabar keputusan Sultan Perak, dia dituduh dengan caj hasutan.

On May 11th, High Court declared Mohammad Nizar as the rightful Mentri Besar of Perak after finding that he had never vacated his post as he had not lost the confidence of the majority of the state assemblymen. But as per the country’s Kangaroo Court SOP, the decision of the High Court was subsequently dismissed by the Court of Appeal which declares Zambry as the rightful chief minister.

Pada 11 Mei, Mahkamah Tinggi mengisytiharkan Mohammad Nizar sebagai Menteri Besar Perak yang sah setelah mendapati beliau tidak pernah mengosongkan jawatannya kerana beliau tidak kehilangan keyakinan majoriti ADUN. Tetapi menurut SOP Mahkamah Kangaroo negara, keputusan Mahkamah Tinggi kemudiannya dibatalkan oleh Mahkamah Rayuan yang mengisytiharkan Zambry sebagai ketua menteri yang sah.

In the same breath, Judge Yew said Governor Juhar was acting within his powers when he swore in Shafie less than 48 hours after he swore in Musa, the same way Sultan Azlan Shah of Perak had sworn in Najib’s man Zambry, albeit not within 48-hour. The judge argued that statutory declarations by the 6 Barisan Sabah assemblymen who defected were sufficient to show Musa had lost his majority support.

Dalam masa yang sama, Hakim Yew berkata Gabenor Juhar bertindak dalam kuasanya apabila Shafie mengangkat sumpah jawatan kurang dari 48 jam selepas Musa mengangkat sumpah jawatan Ketua Menteri Sabah. Dengan cara yang sama Sultan Azlan Shah Perak telah berkenan Zambry pilihan Najib mengangkat sumpah jawatan Menteri Besar Perak, walaupun tidak dalam tempoh 48 jam. Hakim berpendapat bahawa pengisytiharan berkanun oleh 6 anggota Dewan Undangan Negeri Barisan Sabah yang membantah mencukupi untuk menunjukkan Musa kehilangan sokongan majoriti.

Musa Aman’s refusal to resign mirrored that of Perak ex-Chief Minister Mohammad Nizar. In fact, former Information Minister Ahmad Shabery Cheek had claimed that Nizar’s refusal to resign was an act of treason. Therefore, taking a page from Perak Constitutional Crisis, Judge Yew agreed that Musa is deemed to have vacated the office along with his state cabinet once he loses the majority.

Keengganan Musa Aman untuk meletakkan jawatan mengingatkan kes bekas Menteri Besar Perak Mohammad Nizar. Malah, Menteri Penerangan ketika itu Ahmad Shabery Cheek mendakwa bahawa keengganan Nizar untuk meletakkan jawatan adalah satu tindakan pengkhianatan. Oleh itu, mengambil satu halaman dari Krisis Perlembagaan Perak, Hakim Yew bersetuju bahawa Musa dianggap telah mengosongkan jawatan itu bersama kabinet negerinya apabila dia kehilangan majoriti.

Judge Yew also argued that the governor did not need to wait for a motion of no-confidence to be tabled against Musa in the state assembly. Based on the 2009 Perak Constitutional Crisis, she was convinced a vote of no-confidence is not the only method to determine whether a chief minister of Sabah (Musa Aman) had lost his majority support.

Hakim Yew juga berpendapat bahawa gabenor tidak perlu menunggu undi tidak percaya terhadap Musa di dewan negeri. Berdasarkan Krisis Perlembagaan Perak 2009, beliau yakin undi tidak percaya bukanlah satu-satunya cara untuk menentukan sama ada Ketua Menteri Sabah (Musa Aman) telah kehilangan sokongan majoritinya.

Until today, it’s debatable whether the Perak Sultan’s decision was wrong as far as the rule of law is concerned. That decision, made in haste, basically means the Mentri Besar (Chief Minister) holds office at the pleasure of the Sultan, when in fact it is not. The Sultan – a constitutional monarch – had no power to dismiss Nizar, let alone to request his resignation.

Sehingga ke hari ini, ia boleh dibahaskan sama ada keputusan Sultan Perak adalah salah terhadap undang-undang berkenaan. Pada dasarnya keputusan itu dibuat secara tergesa-gesa, bermakna Menteri Besar memegang jawatan dengan perkenan Sultan, padahal sebenarnya tidak. Sultan - raja berperlembagaan - tidak mempunyai kuasa untuk menolak Nizar, apatah lagi untuk meminta beliau meletakan jawatannya.

Had Sultan Azlan Shah of Perak allowed former Perak Chief Minister Nizar’s request for the dissolution of the state assembly to pave way for a snap election back in 2009, or at least allowed a vote of no-confidence to be tabled (just to prove PM Najib had the numbers), perhaps Musa Aman could win his case and Barisan Nasional would be returned to power in Sabah today.

Sekiranya Sultan Azlan Shah dari Perak membenarkan bekas Menteri Besar Perak Nizar untuk membubarkan Dewan Undangan Negeri sebagai pembuka jalan untuk pemilihan semula pada 2009, atau sekurang-kurangnya membenarkan undi tidak percaya dilaksanakan (hanya untuk membuktikan PM Najib menggunakan kuasa dan pengaruhnya), mungkin Musa Aman boleh memenangi kesnya dan Barisan Nasional akan kembali berkuasa di Sabah hari ini.

It certainly didn’t help that Raja Eleena Raja Azlan Shah, the daughter of the then-Sultan Azlan Shah of Perak, coincidently was the second richest woman on the 2008 Forbes 40 Richest Malaysians at #35 spot, by virtue of her being the single largest shareholder of Gamuda, the largest engineering and construction company in Malaysia – via her 7.5% stake in Generasi Setia (M) Sdn Berhad.

Ia pasti tidak membantu Raja Eleena Raja Azlan Shah, anak perempuan Sultan Azlan Shah dari Perak. Kebetulan beliau adalah wanita kedua terkaya pada tahun 2008 oleh Forbes 40 Richest Malaysians di tempat # 35. Oleh kerana beliau adalah pemegang saham terbesar Gamuda, syarikat kejuruteraan dan pembinaan terbesar di Malaysia - iaitu melalui pegangan 7.5% saham dalam Generasi Setia (M) Sdn Berhad.

With personal wealth at US$228 million back then (RM947 million based on today’s exchange rate), Raja Eleena would depend on tons of contracts or projects from Najib government to keep the money flowing. Of course, the Perak Constitutional Crisis is water under the bridge now. But that piece of shameful episode is being used against the Barisan Nasional. Ain’t Karma a bitch? - FT

Dengan kekayaan peribadi yang bernilai AS$228 juta (RM947 juta berdasarkan kadar pertukaran hari ini), Raja Eleena bergantung kepada banyak kontrak atau projek dari kerajaan Najib untuk mengekalkan aliran kewangannya. Nasarudin is first BN rep to join Opposition

PETALING JAYA: Bota assemblyman Datuk Nasarudin Hashim is quitting Umno to join PKR, making him the first Barisan Nasional elected representive to join the opposition party after the general election last year.
News of his defection sent shockwaves in Umno circles in Perak and around the country.
Pakatan Rakyat will now have 32 assemblymen in Perak, with Umno having one fewer at 27.
Nasarudin, 58, said his decision to jump ship was due to political developments and people’s support for the Opposition during the general election and the current situation in Umno.
Nasarudin was introduced as a PKR recruit by party adviser Datuk Seri Anwar Ibrahim at a press conference held at the party’s headquarters here yesterday.
The former Parit MP (2004-08) had won the Bota state seat last year by defeating Kapt (Rtd) Usaili Alias of the PKR by a 2,068-vote majority, polling 6,556 votes against the former’s 4,448.
Nasarudin, 58, who joined Umno in the 1970s, said he was entering PKR with immediate effect but would submit his resignation letter to Umno later.
“I am confident PKR will continue to uphold and respect the Constitution with regards to the position of Bahasa Melayu as the official national language, the position of the Rulers and Islam as the federal religion.
“I believe PKR and its partners in Pakatan Rakyat are able to be a better coalition of component parties for the people’s benefit,” he said.
Nasarudin. a former Felcra Bhd chairman, said by joining PKR he would be able to be a more effective assemblyman, especially with Pakatan Rakyat holding the reins of the state government in Perak.
Calling him an important leader in Perak, Anwar said Nasarudin’s decision was critical because it reflected the sentiments of his voters, particularly the Malay constituents.
“He is responding to that demand. We welcome him and I see it as a beginning of a new wave,” said Anwar.

"Saya cukup berani keluar Umno" - Nasarudin

IPOH: Ahli Dewan Undangan Negeri (ADUN) Bota, Datuk Nasarudin Hashim sambil menegaskan beliau "cukup berani" untuk menyertai Parti Keadilan Rakyat (PKR) berkata, beliau keluar Umno bukan kerana tidak berpeluang bertanding dalam pemilihan parti di Bahagian Parit tahun lalu.

"Ia tiada kaitan dengan itu dan perkara itu tidak timbul sama sekali," kata beliau yang keluar Umno Ahad lalu.

Malah kata Nasarudin, jika beliau lemah sudah pasti tidak berani untuk meninggalkan Umno dan menyertai PKR.

"Masih ada semangat untuk berjuang dalam diri saya," kata beliau selepas menemui pengundi-pengundinya malam tadi.

Beliau berucap dalam sesi Ceramah Khas Mesra Rakyat di Stadium Bakri Rais, Bota Kanan dekat sini.

Ia antara lain bagi menjelaskan kepada rakyat di kawasannya mengenai pendirian beliau keluar Umno dan menyerta PKR.

Ia dianjurkan oleh PKR.

Turut hadir ialah Penasihat PKR dan Ketua Umum Pakatan Rakyat, Datuk Seri Anwar Ibrahim.

Dalam ceramah itu, Nasarudin turut meminta ADUN Umno yang lain di Perak supaya menyertai PKR.

"Saya fikir mereka cukup matang untuk berfikir bagi diri masing-masing," katanya.

Sambil menyifatkan kehadiran yang ramai dalam ceramah itu, Nasarudin menjelaskan, beliau tidak pernah menyaksikan jumlah itu termasuk ketika kempen pilihan raya umum yang lalu.

"Justeru, ia adalah jelas bahawa orang ramai menyokong saya dan mereka gembira," katanya.

Beliau juga berkata, PKR tidak menawarkan apa-apa kepadanya untuk menyertai Pakatan Rakyat.

Dalam pada itu, Anwar pula berkata, beberapa ADUN Barisan Nasional juga ada menghubunginya untuk menyertai PKR.

Bagaimanapun beliau enggan mengulas lanjut perkara tersebut.

PARIT 1 Feb. - Lebih 200 pengundi dari Kampung Ekor Bota hari ini berhimpun di dewan orang ramai kampung itu bagi merayu Ahli Dewan Undangan Negeri (ADUN) Bota, Datuk Nasaruddin Hashim kembali ke pangkuan UMNO.

Kumpulan itu yang terdiri daripada ahli UMNO Cawangan Ekor Bota mula berkumpul dari pukul 10.30 pagi sambil membawa sepanduk serta kain rentang yang antaranya tertera 'Kembalilah Datuk Nasa', 'UMNO Masih Sayang Datuk Nasa' dan 'Jangan Kecewakan Pengundi'.

Perhimpunan itu berakhir kira-kira pukul 12 tengah hari selepas kumpulan berkenaan menyerahkan memorandum kepada pegawai peribadi ADUN Bota, Syed Muhammed Syed Ramli untuk diserahkan kepada Nasaruddin.

Judge Used 2009 Perak Constitutional 
Crisis To Throw Out Musa’s Claim...

On paper, it appeared Musa Aman could easily reclaim his old job as Sabah Chief Minister. Mr. Musa, who has been charged of pocketing US$63.3 million (RM264 million) as bribes in exchange for logging concession contracts to 16 companies and was slapped with 35 charges, has claimed that his dismissal as chief minister was illegal and against the state constitution.

After all, Musa was the first to be sworn in by the Yang di-Pertuan Negeri (Governor) Juhar Mahiruddi on May 10th, just a day after the historical May 9th general election that left Sabah with a hung state assembly. Back then, Musa led Sabah Barisan to win 29 seats while opposition Warisan and its partners (DAP and PKR) also won 29 seats in the 60-seat Sabah State Legislative Assembly.

However, thanks to “froggie” state assemblyman Jeffery Kitingan who switched sides, Musa was eventually sworn in. But it was a short-lived victory for the Sabah Barisan, part of the Barisan Nasional coalition which unexpectedly lost its power for the first time in 61 years on that fateful day. Within 48-hour, Musa lost his chief ministership following a defection of 6 of his own assemblymen.

With 35 seats, opposition Warisan and its partners – DAP and PKR – has more than enough seats to form the state government. Hence, Governor Juhar swore Warisan President Shafie in as Chief Minister on May 12th. Furious, Mr. Musa disputed his removal, saying that he never tendered his resignation as chief minister. He then filed a lawsuit, seeking a declaration that he is the lawful Sabah chief minister.

Ahh, while Musa Aman, his lawyers and opposition Barisan Nasional were confident they could take back the state of Sabah, Kuching High Court Judge Yew Jen Kie has prepared a surprise for them. The judge declared that the May 12 appointment of Warisan President Shafie Apdal by the Governor Juhar Mahiruddin was valid under the Sabah constitution.

The best part of the ruling was the reason presented by Justice Yew in arriving at her decision. She cleverly used a Federal Court ruling triggered by Barisan Nasional itself about 9 years ago as the basis of her decision – the 2009 Perak Constitutional Crisis. In that crisis, the same drama happened. The difference is the roles were being reversed.
