KUALA LUMPUR: Mahkamah Tinggi hari ini membenarkan permohonan bekas Perdana Menteri Datuk Seri Najib Razak untuk membatalkan saman dikemukakan terhadapnya oleh bekas Ketua Jabatan Siasatan Jenayah Kuala Lumpur, Datuk Mat Zain Ibrahim berhubung upacara angkat sumpah Perdana Menteri.

Ia berikutan Mat Zain mendakwa upacara angkat sumpah jawatan Perdana Menteri oleh Najib pada tahun 2009 tidak mengikut Perlembagaan.

Peguam Nur Shafiqa Balqish Jaffri yang mewakili Najib ketika ditemui pemberita, berkata Hakim Mahkamah Tinggi, Datuk Mohd Zaki Abdul Wahab membenarkan permohonan anak guamnya untuk membatalkan writ saman itu kerana mendapati ia remeh dan membazirkan masa mahkamah.

Beliau berkata, mahkamah berpendapat bahawa kes saman itu sudah tidak relevan kerana upacara angkat sumpah itu berlaku pada tahun 2009 dan Najib kini bukan lagi seorang Perdana Menteri.

"Berikutan itu, ia kini sudah bersifat akademik. Mahkamah dengan itu membatalkan saman terbabit dan memerintahkan defendan (Mat Zain) membayar kos sebanyak RM5,000," katanya.

Dalam prosiding di kamar hakim itu, Mat Zain diwakili peguam Adenan Ismail.

Mat Zain memfailkan writ saman itu pada 23 Mac lalu dan mengikut pernyataan, beliau mendakwa bahawa upacara Angkat Sumpah Jawatan dan Taat Setia yang dibuat Najib pada 3 April 2009 tidak mengikut Perlembagaan dan dengan itu adalah tidak sah dan terbatal.

Beliau dengan itu memohon perisytiharan bahawa defendan (Najib) tidak berkelayakan daripada menjadi seorang Perdana Menteri atau Menteri Kewangan sejak 3 April 2009.

Plaintif mendakwa, defendan juga menukar keseluruhan bentuk dan maksud asal Sumpah Jawatan dan Setia berkenaan.

Turut dipohon, relif lain yang yang difikirkan wajar oleh mahkamah.

KUALA LUMPUR, July 6 — Datuk Seri Najib Razak's son was spotted dining and drinking wine with an actress in Taiwan a day after his father was charged here over RM42 million from a former 1Malaysia Development Berhad (1MDB) unit, a news portal reported today.

Taiwan's Apple Daily claimed it witnessed Datuk Mohd Nazifuddin Mohd Najib dining and chatting last night with an actress identified as Celia Zhang, purportedly at a steak restaurant in the Breeze Xinyi mall near Taiwan capital's iconic tower Taipei 101.

The portal said the two were seen drinking glass after glass of red wine in a relaxed atmosphere during an allegedly mirthful meal that lasted three hours, claiming that two bottles of red wine were opened. 

It also said the duo were subsequently seen taking a taxi to a massage parlour, before having a candlelight dinner and spending two hours at a bar. 

Apple Daily claimed that the two then took another taxi ride to the Grand Hyatt hotel at around 1am. 

According to Apple Daily, Nazifuddin wrote a Facebook post at 9.58pm the same night to back his father who was charged with corruption, noting that this allegedly took place while he was having a candlelight dinner with the actress. 

The Apple Daily report came with a video clip showing brief footage and photos of the duo together, also reporting that Nazifuddin was seen together with the actress after he alighted from the plane yesterday in his trip to Taiwan. 

When Zhang was asked about the duo's Thursday meeting caught on video, Apple Daily reported that the actress replied via her spokesman that: "He is just a good friend that I have known for many years and who came to Taiwan to visit, I acted as his guide and accompanied him."

When asked about their sighting at the Grand Hyatt hotel, the actress reportedly clarified that they only had more drinks there. 

"We only drank at the Grand Hyatt's bar, his mood was not good because his family member was ill, after that he went up to rest and I then left,” she was quoted as saying. 

The actress indicated that they did not discuss the news about Najib, reportedly telling the portal that she and Najib’s son generally avoided politics due to the sensitive nature of the topic. 

Apple Daily said Nazifuddin returned this morning to Malaysia, also claiming that the former Umno president's son was first introduced by friends in Taiwan three years ago to the actress. 

The newspaper claimed that the actress previously did not know of Nazifuddin's status and background and had only started close communications with him recently after she became single again. 

In a separate report by Apple Daily, the actress is aged 34 and is a former model of Chinese-Vietnamese parentage who is now an actress and has been in the entertainment industry for four years. 

Nazifuddin had in a March 29, 2018 statement posted on his Facebook account announced that he was temporarily withdrawing himself from the political arena until he feels it is appropriate to be active in Umno again. 

Najib was charged on Wednesday in Kuala Lumpur with three counts of criminal breach of trust as a public servant and one count of abusing his position for self-gratification over ex-1MDB subsidiary SRC International Sdn Bhd's RM42 million funds. 

He has pleaded not guilty to all charges that are each can be punished by a maximum 20-year jail term and fine, with CBT also punishable by whipping. He was released on bail of RM1 million that was paid in half, with the remaining RM500,000 due next Monday

Nazifuddin was seen along with Najib's other children Norashman, Mohd Nizar, Nooryana Najwa and the latter two's spouses on Wednesday in the courtroom when Najib was charged.

KUALA LUMPUR, July 6 — Prime Minister Tun Dr Mahathir Mohamad expressed disappointment that Saudi Arabia did not comment on Datuk Seri Najib Razak’s claim that the RM2.6 billion deposited in his account was a “donation” from one of the kingdom’s royalty.

In an interview with al-Jazeera's “Talk to Al Jazeera”, Dr Mahathir said there was no proof to confirm or deny that the princely sum originated from and returned to the country, as previously alleged by the former prime minister.

“So we can't accuse Saudi Arabia, unless of course, there is proof that Saudi Arabia has tried to interfere in Malaysian politics,” Dr Mahathir was quoted saying.

The donation was first reported over three years ago by The Wall Street Journal, launching the country into a prolonged saga over 1Malaysia Development Bhd (1MDB) that culminated in Najib leading Barisan Nasional to defeat in the 14th general election.

Najib maintains to this day that the RM2.6 billion was a political donation to Umno and claimed again this week that it was cleared by Bank Negara Malaysia at the time.

Former BNM governor Tan Sri Zeti Akhtar Aziz denies this.

However, Najib also sacked Tan Sri Gani Patail as attorney-general at the time, replacing him with Tan Sri Apandi Ali who then cleared the former PM of any wrongdoing.

Despite this, however, the Malaysian Anti-Corruption Commission (MACC) is now saying it has no evidence that the sum was a donation and no information to corroborate claims that it came from a supposed Saudi prince.

The commission interviewed former deputy prime minister Datuk Seri Ahmad Zahid Hamidi for over eight hours this week as he previously claimed to have met the mysterious Arab donor.

Najib was charged on Wednesday with three counts of criminal breach of trust and one count of power abuse in relation to RM42 million allegedly misappropriated from a former 1MDB unit.

Prior to his prosecution, commercial crime investigators raided locations linked to Najib and seized an estimated RM1.1 billion in cash, jewellery and assorted luxury goods.

Menteri Pendidikan tidak arah murid sumbang THM

PUTRAJAYA: Menteri Pendidikan, Dr Maszlee Malik tidak pernah mengeluarkan arahan bertulis atau lisan kepada sekolah khususnya di Kelantan untuk memberikan sumbangan kepada Tabung Harapan Malaysia (THM) seperti yang viral di media sosial.

Perkara itu dijelaskan Kementerian Pendidikan menerusi kenyataan hari ini berhubung yang menafikan dakwaan arahan berkenaan.

"Hasil siasatan dijalankan, ia adalah inisiatif Jabatan Pendidikan Negeri Kelantan yang melaksanakan kempen kutipan Tabung Harapan Malaysia di sekolah seluruh negeri Kelantan.

"Bagaimanapun, pelancaran kutipan tabung itu sudah dibatalkan oleh Jabatan Pendidikan Negeri Kelantan," katanya.

Kenyataan kementerian itu untuk menjelaskan satu surat dikeluarkan oleh Jabatan Pendidikan Negeri Kelantan mengenai makluman pelancaran dan pelaksanaan THM peringkat negeri Kelantan yang dijadual esok.

Surat berkenaan menyebut, pihak sekolah dialu-alukan untuk turut menderma sebagai tanda sokongan dan kecintaan kepada negara.

Pada masa sama, surat berkenaan turut menyatakan dua nombor akaun untuk menyumbang iaitu satu untuk sekolah menengah dan satu untuk sekolah rendah.

Musa Aman disaman RM400 juta?

BEKAS Ketua Menteri Sabah, Tan Sri Musa Aman dinamakan dalam satu saman oleh penama, Zulkifli Kassim, dari Kampung Bobot, Kota Belud, berhubung dakwaan penyelewengan wang Yayasan Sabah.

Notis undang-undang yang diterbitkan dalam akhbar tempatan kelmarin, menyatakan Zulkifli sudah memfailkan saman ke Mahkamah Tinggi Kota Kinabalu terhadap Musa.

Zulkifli menuntut RM400 juta dengan faedah lapan peratus setahun; kos dan apa-apa perintah yang difikirkan perlu oleh mahkamah.

Sekiranya Musa ingin mempertahankan tindakan itu, beliau mesti menjawab dalam tempoh 10 hari di Pejabat Pendaftar Mahkamah di Kota Kinabalu. Musa kini dilaporkan berada di United Kingdom kerana mendapatkan rawatan kesihatan. Sementara itu, peguam Musa, Tengku Fuad Ahmad, berkata beliau sudah menerima saman berkenaan. 

Dalam kenyataan kepada media, Tengku Fuad berkata, writ difailkan terhadap Musa lebih bersifat politik dan untuk memalukan anak guamnya. “Writ dua muka surat itu yang menuntut kira-kira RM400 juta dari Tan Sri (Musa) jelas didorong oleh politik semata-mata dan direka untuk memalukan dan mengganggu klien saya. Selain itu, ia tidak ada apa-apa isi (kandungan). 

“€Kota Kinabalu adalah sebuah bandar kecil dan semua orang tahu bahawa firma saya mewakili Musa. Oleh itu, saya tertanya-tanya mengapa plaintif memilih untuk menerbitkan writ dalam akhbar? “Adakah ini direka untuk memalukan klien saya? Saya juga mendapati writ itu seolah-olah telah digubal oleh seorang peguam. Siapa yang bersembunyi di belakang plaintif,”€ katanya. Bagaimanapun, Tengku Fuad berkata, pihaknya akan mengambil tindakan seperti dikehendaki bagi menghormati proses mahkamah.
